Welcome to Vara Pavers & Outdoors (“Vara Pavers,” “we,” “our,” or “us”). These Terms and Conditions govern your use of our website located at varapavers.com and our paver installation, concrete, artificial turf, pool deck, pergola, hardscaping, and related outdoor improvement services.
By accessing our website, requesting a quote, communicating with us, or using our services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these Terms and Conditions, please do not use our website or services.
Vara Pavers & Outdoors provides outdoor improvement services, including paver installation, concrete work, artificial turf installation, pool decks, pergola construction, and related outdoor construction and hardscaping services.
All services are subject to availability, site conditions, weather, material availability, permitting requirements, property access, and agreement on pricing and scope of work.
We reserve the right to refuse or discontinue service when reasonably necessary, including for unsafe working conditions, non-payment, inaccessible work areas, or circumstances outside our control.
Quotes and estimates are based on the information available at the time of the initial property assessment and may change if additional work, materials, preparation, demolition, drainage correction, excavation, or other services are required.
Estimates are non-binding unless otherwise stated in writing.
Prices may vary depending on labor, materials, site conditions, measurements, access, project complexity, and project scope.
Material pricing and availability may change before materials are ordered.
Any additional work or changes requested by the client may result in additional charges.
Hidden or unforeseen site conditions discovered after work begins may require a revised price or scope of work.
Any change to the original project scope may require written or verbal client approval before additional work is performed.
Payment terms will be provided before the start of a project and may also be stated in the applicable estimate, proposal, invoice, or contract.
A deposit or initial payment may be required before scheduling, ordering materials, or beginning work.
Remaining payments may be required according to agreed project milestones or upon completion.
Special-order or custom materials may require advance payment.
Late or unpaid balances may result in work being delayed or suspended.
Vara Pavers & Outdoors reserves the right to suspend or cancel services for non-payment, subject to applicable law.
Clients are responsible for paying all agreed charges for completed work, approved changes, materials, and additional services.
Vara Pavers & Outdoors strives to complete projects according to the estimated schedule. However, all project dates and completion timelines are estimates unless expressly guaranteed in writing.
Delays may occur because of weather, rain, storms, permit or inspection delays, material shortages, supplier delays, site conditions, equipment issues, changes requested by the client, or other circumstances outside our reasonable control.
Clients may request to reschedule services with reasonable advance notice.
Last-minute cancellations or rescheduling may be subject to fees or costs already incurred.
Deposits for specially ordered materials or expenses already incurred may be non-refundable where permitted by law.
We reserve the right to reschedule work when necessary because of weather, unsafe conditions, scheduling conflicts, or other circumstances beyond our reasonable control.
Clients must provide reasonable and safe access to the property and work area during scheduled service and construction periods.
The client is responsible for:
Informing Vara Pavers & Outdoors of known underground or concealed utilities, irrigation systems, electrical lines, plumbing, drainage systems, septic systems, cables, pipes, structures, or other hidden conditions.
Removing personal belongings, vehicles, furniture, decorations, and other items from the work area when requested.
Securing pets and maintaining a safe work area.
Providing necessary access through gates, driveways, yards, or other areas.
Informing us of HOA rules, property restrictions, access limitations, or other special conditions that may affect the project.
Obtaining HOA or property-owner approvals when they are the property owner’s responsibility unless otherwise agreed in writing.
Vara Pavers & Outdoors is not responsible for damage to hidden, unmarked, incorrectly marked, deteriorated, or improperly installed items that could not reasonably have been identified before work began.
Outdoor construction materials may naturally vary in color, shade, texture, pattern, dimensions, and appearance.
Pavers, concrete, turf, stone, and other outdoor materials may also change in appearance over time because of sunlight, weather, moisture, staining, normal wear, settling, vegetation, chemicals, irrigation, pool water, or other environmental conditions.
Minor color variations, surface variations, settling, efflorescence, natural wear, and other characteristics inherent to outdoor materials are not necessarily defects in workmanship.
The client understands that existing drainage, soil conditions, tree roots, underground conditions, neighboring properties, pre-existing construction, and natural weather conditions may affect the long-term performance of outdoor improvements.
Any warranties specifically provided by Vara Pavers & Outdoors will be governed by the written warranty terms supplied to the client.
Vara Pavers & Outdoors takes reasonable precautions while performing services. However, to the fullest extent permitted by applicable law:
We are not responsible for indirect, incidental, special, or consequential damages.
We are not responsible for damage resulting from pre-existing property conditions, hidden defects, improperly installed utilities, underground obstructions, soil movement, tree roots, flooding, severe weather, natural disasters, or other conditions outside our reasonable control.
We are not responsible for damage caused after project completion by improper use, improper maintenance, third-party contractors, vehicles, landscaping work, irrigation problems, pool chemicals, pressure washing, excavation, or modifications performed by others.
We are not responsible for normal wear and tear or naturally occurring changes in outdoor materials.
Nothing in these Terms and Conditions is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
